Terms and Conditions
a) By browsing and (where applicable) placing an order with us from this Online Store you agree to be bound by these Online Store Terms and Conditions, the Guide to Online Shopping, the AusTechExpress.com site terms and conditions, any additional terms and conditions included in your order form or presented during the purchasing process and any other terms or conditions required to be implied by law (the "Conditions"). References in the AusTechExpress.com site terms and conditions to "this site" include this Online Store.
b) This Online Store is operated by Aus Tech Express :: A division of EMS Pty. Ltd. (ABN 98 225 422 941) ("Aus Tech Express") and all purchases made through it are processed by EMS P/L. Billing on the credit card statement will appear as "Aus Tech Express".
c) Mobile voice and data services and handsets purchased under a Mobile Payment Plan ("MPP") through this Online Store are sold to you by Enhanced Multimedia Services as agent for Vodafone Pty Ltd (ABN 98 225 422 941). Other handsets, accessories and devices are sold to you by Aus Tech Express in its own right.
d) In these Online Store Terms and Conditions, references to "us", "we" and "our" refer to each of Aus Tech Express and EMS P/L, unless stated, or the context implies, otherwise.
2. Your warranties
a) To make a purchase through this Online Store on your own behalf:
• YOU MUST SUPPLY THE A.B.N. OR A.C.N. OF YOUR BUSINESS
• you must be 18 years of age or over, or if you are under 18 years of age, you must have your parent or guardian's consent to make the purchase and enter into the terms and conditions applying to the purchase;
• you must live in Australia;
• delivery of the product(s) ordered must be to your address in Australia;
• you must be authorised to use the credit card used to make your purchase; and
• you must be buying for your own use and not for resale.
b) If you are purchasing on behalf of a company, association, partnership or other such entity ("Entity"):
• you must be authorised to enter into these Online Store Terms and Conditions on behalf of the Entity;
• you must be authorised by the Entity to make the purchase;
• the Entity must be located in Australia;
• delivery of the product(s) ordered must be to the Entity's address in Australia; and
• you must be authorised to use the Entity's credit card used to make the purchase.
c) By making a purchase through the Online Store you warrant that you meet the relevant conditions above.
d) References in the Conditions to 'you' includes any Entity (as defined above) you represent, where applicable.

4. Title & Responsibility
Title to, and responsibility for, each product you order passes from us to you when the product is delivered to you.
5. Limitation of Liability
a) Our liability to you in connection with your use of the Online Store is limited as described in the Conditions.
b) To the extent permitted by law, we and our employees, officers, agents and contractors exclude all liability for any loss or damage (including without limitation, indirect, special or consequential loss or damage) arising from the use of this Online Store whether or not this is caused by a negligent act or omission. To the extent that we are prohibited at law from excluding our liability, we limit our liability to the extent permitted by law, to the resupply of the relevant goods or services.
6. General
a) All prices quoted for products and/or services from this Online Store are in Australian dollars and include GST, where applicable, unless expressly stated otherwise. We will only accept payment for your order with one of the following major credit cards, issued in Australia: Visa, MasterCard and American Express. Any credit cards that you use must be valid at the date of making your purchase.
b) There is a limit of $3600 on the value of products and/or services that can be purchased by any individual or on any individual credit card in any one transaction. We reserve the right to limit the number of any products and/or services that may be purchased in any transaction (see below). These limits may change from time to time without notice. Please note that current restrictions determine that you will only be allowed:
• to purchase a maximum of 2 notebooks per order;
• a maximum of 3 orders can be sent to any one address per month;
• a maximum of 3 credit card debits per credit account per month
c) If any provision of the Conditions is held to be invalid or unenforceable, that provision will be severed and the other provisions will remain in full force and effect.
d) Products and services offered in this Online Store, and their prices, are subject to change without notice.
e) Once we give you online confirmation of your purchase your order enters the "processing" stage it cannot be cancelled. However, we do operate a returns policy (see Returns Guide).
f) When you place an order through this Online Store, we may verify your method of payment, shipping address and/or other details before processing your order. When you submit details to make a purchase, a credit card validation is carried out by our third party credit card payment agent - SecurePay. We will send you an email confirming receipt of your order however, this email shall not constitute an acceptance of your order.
g) Your placement of an order via this Online Store is an offer to purchase our products or services. We may accept your order by processing your payment and shipping the product or documentation of service, or may, for any reason, decline to accept your order or any part of your order. No order shall be considered to be accepted by us until the product or documentation has been shipped. If we decline to accept your order, we will attempt to notify you using the e-mail address you have provided with your order.
